Ikpeazu wins first appeal




Governor Okezie Ikpeazu of Abia State has won the first appeal delivered by the Court of Appeal in Abuja with respect to the judgments of the Federal High Court in Abuja June 27 removing him from office.
Ikpeazu’s appeal was with respect to the ruling delivered by Justice Okon Abang of the Federal High Court in Abuja on July 8 in which the judge insisted that he had jurisdiction to hear a motion for stay of execution of his earlier judgments delivered on June 27 even after the appeals against the judgments had been entered.
The Justice Helen Ogunwumiju-led five-man bench unanimously agreed in their judgment that Justice Abang erroneously assumed jurisdiction to hear the motion and adjourned it till a later date.
Justice Philomina Ekpe, who read the lead judgment, held that what Justice Abang ought to have done in line with time-honoured doctrine of “stari decisis” was to have transferred the motion to the Court of Appeal for determination.
She also held that the Justice Abang wrongly interpreted the provisions of Order 4(10) and (11) of the Court of Appeal rules when he held that the said provisions were only applicable to an interlocutory ruling of the lower court and when a final judgment in a suit had been delivered.
She also held that Justice Abang lacked jurisdictions to interpret the provisions of the Court of Appeal being the rules of a superior court.
In her contribution, Justice Ogunwumiju, held that the trial judge “deliberately stood the law on its head” by justifying his jurisdiction to hear the motion when appeal has been entered.

EFCC re-arrests and detains former Governor of Imo State, Achike Udenwa

 
 
The Economic and Financial Crimes Commission (EFCC) today re - arrested the former governor of Imo State Achike Udenwa in connection with alleged campaign scandal at the last presidential election. Udenwa as a State Co-ordinator for The Presidential Campaign Organisation in Imo State was said to have collected the sum of N350,000,000 (Three Hundred and Fifty Million Naira Only) from the former senator representing Kaduna South and Director of Finance for the PDP presidential campaign organisation, Nenadi Usman.
The suspect, in his statement to the Commission admitted receiving the money via Diamond Bank account No.0058805692 and 005950791 respectively on the 14th and 28th of January 2015 in three separate instalments. He added that the money came from a company named Joint Trust Dimension Limited. This same company was charged alongside MrS Nenadi Usman and the Media Director of the PDP Presidential Campaign Organisation, Femi Fani Kayode before Federal High Court Lagos on a similar allegation.

Investigation however revealed that Achike Udenwa and one Viola Onwuliri, a former Minister of Foreign Affairs and State Minister for Education, who was his deputy at the Presidential Campaign Organization were the two signatories to the Diamond Bank account that received the money.

Upon his arrest, Udenwa was immediately granted administrative bail by the commission with condition that he should be reporting to the commission at an appointed time. But while enjoying his administrative bail, Udenwa chose to deliberately skip reporting, thereby compelling the commission to revoke his administrative bail pending his arraignment soon.

Achike Udenwa was a governor of Imo State under the flagship of People’s Democratic Party between 1999 and 2007 and became a minister of Commerce and Industry between 2008 and 2010 under Goodluck Jonathan’s administration.
